1. Service Description
AppsPulse is a dual-platform application health monitoring service ("Service") that aggregates data from Google Play and Apple App Store to provide developers with unified analytics. The Service includes: a unified dashboard displaying cross-platform app metrics; Android Vitals monitoring (crash rates, ANR rates, startup time, rendering performance) with multi-dimension drill-down; review aggregation and management with in-platform reply capabilities; revenue and financial analytics; customizable threshold-based alerts and notifications; workspace-based team collaboration with role-based access control. Some features are available only on specific plans. Feature availability is described on our pricing page.
2. User Accounts
You must be at least 16 years old to use AppsPulse. By creating an account, you represent that you are at least 16 years of age. You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@appspulse.org if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
3. Platform Authorization and Compliance
To use AppsPulse, you must connect at least one Google Play or App Store account by providing OAuth authorization or API credentials. By connecting a platform account, you represent and warrant that: you are the authorized owner or an authorized administrator of the connected developer account; you have the right to grant AppsPulse access to the data accessible through that account; your use of AppsPulse complies with Google Play Developer Distribution Agreement, Google API Services User Data Policy, Apple Developer Program License Agreement, and App Store Connect API Terms of Use, as applicable. You are solely responsible for ensuring that your use of AppsPulse does not violate any terms of service of the connected platforms.
4. Acceptable Use
You agree to use AppsPulse only for lawful purposes and in accordance with these Terms. You must not: attempt to gain unauthorized access to our systems, networks, or other users' accounts; use the Service to collect, store, or process data beyond what is authorized by your connected platform accounts; resell, redistribute, sublicense, or make available to third parties any data obtained through the Service; use automated scripts, bots, or scrapers to access the Service outside of our official API; reverse engineer, decompile, or disassemble any part of the Service; use the Service in any way that could damage, disable, or impair our infrastructure; impersonate any person or entity or misrepresent your affiliation. Violation of these terms may result in immediate account suspension or termination.
5. Payment Terms
AppsPulse offers both free and paid plans. Paid plans are billed monthly or annually in advance through our payment processor (PayPal). All fees are quoted in USD and are non-refundable except as required by applicable law. We reserve the right to change pricing with at least 30 days' prior notice. Price changes will not affect your current billing cycle. The free Indie plan is available indefinitely with stated feature and usage limitations. If you downgrade from a paid plan, the change takes effect at the end of your current billing cycle. Failure to pay may result in suspension of paid features until payment is resolved.
6. Data Ownership and Portability
Your data remains yours. AppsPulse does not claim ownership of any data accessed through your connected platform accounts or any content you create within the Service. We are granted a limited, non-exclusive license to use your data solely to provide and improve the Service. You may export your data at any time through the Service's export features. Upon account deletion, we will permanently remove your data within 30 days, except for aggregated anonymized statistics and data we are required to retain by law.
7. Intellectual Property
The AppsPulse platform, including its software, design, logos, documentation, and all original content, is owned by AppsPulse and is protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on our Service without prior written consent.
8. Third-Party Services and Dependencies
AppsPulse relies on third-party services and APIs, including but not limited to: Google Play Developer API and Google Play Developer Reporting API; Apple App Store Connect API; Cloudflare (hosting, edge computing, data storage); PayPal (payment processing). We are not responsible for the availability, accuracy, or reliability of these third-party services. Changes to third-party APIs, terms of service, or availability may affect AppsPulse functionality. We will make reasonable efforts to adapt to such changes but cannot guarantee uninterrupted service. Your use of connected platform features is subject to the respective platform's terms and policies.
9. Disclaimer of Warranties
AppsPulse is provided on an 'as is' and 'as available' basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that: the Service will be uninterrupted, timely, secure, or error-free; the data displayed will be accurate, complete, or current (data is sourced from third-party platforms and may be subject to delays, caching, or inaccuracies); the Service will meet your specific requirements; any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by applicable law, AppsPulse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or relating to your use of or inability to use the Service. Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) USD $100.
11. Termination
Either party may terminate this agreement at any time. You may cancel your account through the application settings or by contacting support@appspulse.org. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or illegal activity, or fail to pay applicable fees. Upon termination: your right to access and use the Service ceases immediately; we will delete your account data within 30 days in accordance with our Privacy Policy; any outstanding payment obligations survive termination; provisions that by their nature should survive (including Sections 7, 9, 10, and 12) will continue to apply.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by applicable law.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance via email to the address associated with your account and through a notice in the Service. Your continued use of AppsPulse after the effective date of any changes constitutes your acceptance of the updated Terms.
